These Terms of Service ("Terms") govern your use of Control Tower ("Service"). By installing or using the Service, you agree to these Terms.

1. The Service

Control Tower is a software service that connects to your Intercom workspace and monitors support conversations for customer risk signals including churn intent, refund threats, and escalation patterns. The Service provides a dashboard, alerts, and reporting tools to help support teams prioritize high-risk conversations.

2. Account and Access

• You must have a valid Intercom workspace to use this Service
• You are responsible for maintaining the security of your account credentials
• You may not share your account with users outside your organization
• You must be authorized to connect your organization's Intercom workspace to third-party services

3. Subscription and Billing

• Free trial: All new accounts receive a 14-day free trial. No payment is required during the trial period
• Paid plans: After the trial, continued access requires a paid subscription (Starter $99/mo, Growth $499/mo, Scale $1,500/mo)
• Billing: Subscriptions are billed monthly via PayPal. Prices are in USD
• Cancellation: You may cancel your subscription at any time through your PayPal account. Access continues until the end of the current billing period
• Refunds: We do not offer refunds for partial billing periods. If you believe you were charged in error, contact us within 30 days
• Plan limits: Each plan includes a monthly conversation limit. If your usage exceeds the limit, new conversations will not be processed until the next billing period

4. Acceptable Use

You agree not to:

• Use the Service to process data for organizations other than your own
• Attempt to circumvent plan limits or access controls
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use the Service in any way that violates applicable laws or Intercom's terms of service
• Resell or sublicense access to the Service without written permission

5. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You retain ownership of your data. We process your Intercom conversation data solely to provide the Service.

6. Service Availability

We aim for high availability but do not guarantee uninterrupted service. The Service is provided "as is" without warranty of any kind. We reserve the right to perform maintenance, update, or modify the Service at any time.

7. Limitation of Liability

To the maximum extent permitted by law, Control Tower shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of data, or loss of customers, arising from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid for the Service in the 3 months preceding the claim.

8. Termination

We may suspend or terminate your access to the Service if you violate these Terms or if your subscription lapses. You may terminate your account at any time by cancelling your subscription and requesting data deletion. Upon termination, your data will be deleted within 30 days.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the dashboard. Continued use of the Service after changes constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by applicable law. Any disputes shall be resolved through good-faith negotiation before pursuing legal remedies.
